HAMPTON PARK COMMUNITY ASSOCIATION DECLARATION AMENDMENT PROCEDURE

The process to change the Declaration of Rights, Restrictions, Affirmative Obligations & Conditions or the Declaration of Covenants & Restrictions is stated in Part IV, 3:  Amendments:  All proposed amendments to the Declaration shall be submitted to a vote of the Owners at a duly called meeting.  The procedures for notice of meeting and voting shall be the same as those set forth in the Bylaws and Articles of Incorporation of the Association for meetings of all Members.  Any such amendment shall be deemed approved if two-thirds (2/3rds) of the Members present at such meeting in person or by proxy vote in favor thereof.  Two-thirds of the members is 502.5 homeowners.

Examples of Declaration Amendments: 

Quorum change – Current Quorum requirement is 30% of total voting membership. 

Date of annual meeting – current annual meeting March

Addition of a Rental Cap

Change in number of board members

Change in terms of board members
